§ 1. General Provisions
- Platform Operator: The Set and Love internet platform, available at https://setandlove.com (including as a PWA application), is operated by PERFECTCLUE Sp. z o.o. with its registered office in Rzeszów, ul. Zimowit 42, 35-605 Rzeszów, Poland, entered into the Register of Entrepreneurs of the National Court Register (KRS) under number: 0000986621, NIP (Tax ID): 8133882813, REGON: 522791227 (hereinafter: the "Service Provider").
- Contact: Contact with the Service Provider is possible via e-mail: [email protected].
- Territorial Scope: The Platform is global in nature; however, it is operated from the territory of the Republic of Poland and is subject to Polish jurisdiction in legal matters.
- Age Restriction: The Platform is intended exclusively for adults who, under the laws of their country, possess full legal capacity (18 years of age or older).
- Availability of Terms: These Terms and Conditions are made available to Users via the Platform in a form that allows for their downloading, recording, and printing.
- Obligation to Read: The User is obliged to read the Terms and Conditions before using the Platform.
- Acceptance of Terms: Use of the Platform constitutes the User's acknowledgement that they have read the Terms and Conditions, accept their terms, and agree to abide by them.
§ 2. Definitions
The terms used in these Terms and Conditions shall have the following meanings:
- Platform: The integrated Set and Love IT system (website and PWA application).
- User: A natural person using the Platform who has successfully completed the registration and age verification process.
- Love Assistant: A conversational system based on generative artificial intelligence (AI), constituting the main interface of the Platform.
- Interview: The process of collecting data on the User's preferences, values, and personality, conducted in the form of an interactive chat with the Love Assistant.
- Match: A system-generated proposal for matching two Users based on the compatibility of their profiles ("Vibe Score" and "Look Score").
- Room: Functionality enabling private text message exchange between matched Users.
- Magic Link: A passwordless login mechanism involving identity verification via a unique token sent to an e-mail address.
- FREE / PRO Plan: Service variants specified in the current Pricing List available on the Platform.
§ 3. Technical Conditions for Use of the Platform
- Hardware Requirements: A condition for the full use of services provided on the Platform is the User's use of a device communicating with the Internet.
- Data Transmission Costs: The Service Provider is not a provider of data transmission or telecommunications services. All costs related to data transmission or telecommunications services required to use the Service shall be borne by the Service Recipient based on separate agreements concluded with the providers of such services.
- Network Risks: The Service Provider declares that the public nature of the Internet and the conclusion and performance of the agreement for the use of the Service may involve the risk of acquisition, appropriation, or modification of the Service Recipient's data by unauthorized persons. Consequently, the Service Recipient should apply appropriate technical measures to minimize the aforementioned risks, including antivirus software or identity protection tools for Internet users.
- Maintenance Work: The Service Provider reserves the right to conduct maintenance work on ICT systems, which may cause temporary difficulties or inability to use the Platform (technical breaks).
§ 4. Conclusion of Agreement and Registration
- Registration Process: Registration in the Service does not take place via a traditional form, but through an interactive conversation (Interview) with the Love Assistant.
- Moment of Conclusion of Agreement: The Agreement for the provision of electronic services is concluded, and these Terms and Conditions are accepted, at the moment when the User – after completing the initial stage of the Interview – enters the unique verification code received at the provided e-mail address into the chat window.

Declarations of Will: Entering the verification code is a technical action equivalent to the User submitting the following declarations of will:
- "I declare that I have read the Terms and Conditions and the Privacy Policy and accept their content without reservation."
- "I declare, under pain of criminal liability, that I am 18 years of age or older."
- "I voluntarily consent to the processing of my personal data for the purpose of providing the partner matching service, including profiling."
- Login: Logging into the Platform takes place each time via a unique link ("Magic Link") sent to an e-mail address. The Platform does not store User passwords.
§ 5. Principles of Platform Operation
- Automation and Profiling: The User acknowledges and accepts that the Platform does not have functionality for manually "browsing" or "searching" for other Users. Partner selection is carried out exclusively by automated artificial intelligence algorithms (Love Assistant).
- Human Intervention (GDPR): Despite the service being based on automated decision-making (profiling), the User has the right to obtain human intervention on the part of the Service Provider, to express their own point of view, and to contest the decision of the algorithm (e.g., in the absence of matches). Notifications in this regard should be sent to [email protected].
- Truthfulness of Data: The User is obliged to provide the Love Assistant exclusively with true information. Providing false data (in particular regarding age, marital status, or description of physical characteristics) constitutes a gross violation of the Terms and Conditions and is grounds for permanent deletion of the account.
- No Guarantee: The Service Provider makes every effort to ensure that the matching algorithms are as effective as possible, but does not guarantee finding a partner or the durability of established relationships. Match results are of an auxiliary nature.
§ 6. Safety and Prohibited Content
- The "Room" functionality is intended exclusively for text-based communication. For security and privacy protection reasons, the Platform technically prevents the transmission of graphic files (images) within private chats.
- Users are strictly prohibited from providing or sharing content that is unlawful, vulgar, harassing (including stalking and hate speech), pornographic, or erotic, as well as content promoting commercial activities, scams, or spam.
- The Platform may not be used for the promotion of services, business activities, recruitment, marketing, or client acquisition.
- It is prohibited to impersonate other individuals, create fake profiles, or use the photos, personal data, or likeness of third parties without authorization.
- Service Provider reserves the right to monitor reports of abuse and to block accounts of Users who violate the provisions of this paragraph. Service Provider may temporarily suspend or permanently delete a User’s account in the event of a breach of these Terms, particularly regarding safety rules, content prohibitions, or the provision of false information.
- The User bears full and sole responsibility for all content published on the Platform and for any consequences arising from its disclosure or sharing.
§ 7. Intellectual Property (IP)
- Service Provider's Rights: All rights to the Platform, including the name, logo, concept of the "Love Assistant," "Vibe Score" methodology, "Core Vector," and unique instructions controlling the artificial intelligence (System Prompts), are the exclusive property of the Service Provider.
- AI Technology: The User acknowledges that the Love Assistant utilizes language models provided by third parties (e.g., OpenAI). The Service Provider holds appropriate commercial licenses for their use.
- License to User Content: The User retains copyright to their statements, however, they grant the Service Provider a non-exclusive, royalty-free, global license to process them (including analysis by AI algorithms) to the extent necessary to provide the Matching Service.
§ 8. Disclaimer (AI)
- "AS IS" Service: The Platform is provided on an "as is" basis. The Service Provider grants no guarantees regarding its uninterrupted operation.
- AI Specifics ("Hallucinations"): The User is fully aware that the Love Assistant uses generative artificial intelligence technology (Large Language Models), which by its nature may occasionally generate imprecise information, or information inconsistent with facts or context ("hallucinations"). The Service Provider bears no liability for such system errors.
- Supportive Nature: Any personality analyses, psychological reports generated by AI, and matching suggestions are exclusively for entertainment, supportive, and educational purposes. They do not constitute a medical, psychological, or therapeutic diagnosis and cannot replace professional advice from a specialist.
- Offline Relations: The Service Provider does not verify the identity of Users in the real world (except for e-mail verification). The Service Provider bears no liability for any material or non-material damage arising from meetings of Users outside the Platform.
§ 9. Payments and Subscription (PRO Plan)
- Subscription Model: The service in the PRO Plan is provided in a subscription model. The fee is charged in advance for the selected billing period in accordance with the Pricing List.
- Payment Processing: Payments are handled by an external payment operator (Stripe). The Service Provider does not process or store the User's payment card data.
- Cancellation: The User may cancel the subscription at any time in the account settings. Cancellation results in no fee being charged for the subsequent period. Funds for the current, paid period are non-refundable.
§ 10. Withdrawal from the Agreement (Loss of Right)
- General Rule: A User who is a Consumer generally has the right to withdraw from a service purchase agreement within 14 days.
- Loss of Right (Digital Content): Pursuant to Art. 38 point 13 of the Consumer Rights Act, the right of withdrawal does not apply to agreements for the supply of digital content (PRO Plan) if the performance of the service has begun with the Consumer's express and prior consent before the deadline for withdrawal and after the entrepreneur has informed them about the loss of the right of withdrawal.
- Statement: By purchasing the PRO Plan and accepting the appropriate message before payment, the User consents to the immediate commencement of the service provision and acknowledges the loss of the right to withdraw from the agreement.
§ 11. Complaints and Account Deletion
- Procedure: Complaints regarding the operation of the Platform should be reported to: [email protected]. The consideration period is 14 days.
- Account Deletion: The User may permanently delete their account at any time in the Platform settings. Account deletion is an irreversible operation and results in the removal of all personal data and chat history.
§ 12. Personal Data
- Data Controller: The administrator of the Service Recipients' personal data is the Service Provider, i.e., PERFECTCLUE Sp. z o.o. with its registered office in Rzeszów, ul. Zimowit 42, 35-605 Rzeszów, entered into the KRS: 0000986621, NIP: 8133882813.
- Data Processing: The Service Provider may process the personal data of Service Recipients in accordance with the principles specified in detail in the Privacy Policy.
§ 13. Amendment of Terms
- Right to Amend: The Service Provider reserves the right to make changes to these Terms and Conditions for important reasons, which include in particular: a) changes in legal regulations affecting the content of the Terms and Conditions; b) necessity to adapt the Terms and Conditions to orders, rulings, decisions, or guidelines of state authorities; c) introduction of new functionalities or services on the Platform, as well as modification or withdrawal of existing ones; d) technical or technological changes in the functioning of the Platform; e) necessity to counteract abuse or ensure User safety.
- Notification of Changes: The Service Provider shall inform Users about the planned change of the Terms and Conditions via an e-mail sent to the address assigned to the Account, at least 14 days before the changes enter into force.
§ 14. Final Provisions
- Governing Law: The governing law for the agreement is Polish law.
- Jurisdiction: The competent court for disputes with entrepreneurs is the court having jurisdiction over the Service Provider's registered office. Disputes with Consumers are subject to the jurisdiction of common courts in accordance with the provisions of law.
- ODR: The Consumer has the option to use the ODR platform: http://ec.europa.eu/consumers/odr.
- Effective Date: These Terms and Conditions enter into force on 01.04.2026.
